The govt is meddleing again - they are proposing ALL cars undergoing BIVA will, from JUNE THIS YEAR have to meet CURRENT levels of emissions standards as do new OEM cars. This will kill all current & future builds dead!!!! The 'consultation' give us only to the 2nd of MARCH 2018 to respond or it will be written into law. Whether you believe it affects you or not - write to your MP and the transport secretary NOW or it may well be the end of legal car modifying forever - I kid you not!!! A facebook page with downloadable letters is available so you can use them as templates here; linkAnd the Govt dov is here; linkThe scary sections are 4.4 to 4.13. They don't seem to playing by their own rules with only a 4 week consultation. Here's a quote from the governments code of practice on consultations. Criterion Duration of consultation exercises Consultations should normally last for at least 12 weeks with consideration given to longer timescales where feasible and sensible. The document goes on to say if the consultation runs for a shorter period the consultation document should be clear as to the reasons for the shortened consultation period and ministerial clearance (or equivalent, e.g. in nonMinisterial departments) for the shorter timeframe should be sought. I can't see any reason quoted for the 4 week consultation. The code of practice can be found here www.gov.uk/government/upload.../file47158.pdf

Thanks for posting this on here, I have said before they must have a plan.
I hoped as a side effect of Brexit all this might slow down but it seems to have made them start rushing things through even quicker.

For the thickos, in broad strokes. When does a BIVA apply?
I checked with GOV and they said imports do aswell? Are these just previously unseen models?

Will put out a newsletter thing this week and include this in it for greater visibility. A 4 week consultation rather than 12 is just not on. I hoped as a side effect of Brexit all this might slow down but it seems to have made them start rushing things through even quicker. Wait ... you thought an authoritarian government would move towards less regulation?

Thought they might be might have more important things to be doing, perhaps by being seen to be doing stuff like this they are trying to cover up whats they aren't getting on with.

Biva applies when you modify a car beyond the 8 point system. If you have a monocoque and cut the bulkhead to fit a newer/bigger engine you legally need BIVA (if you get caught).

I've just written an email to the account, however is there any mileage in beginning a petition on this subject? It's a lot easier for people who agree with it to show support in that manner.

The consultation is THE most important thing to answer. Petitions will take too long and count for nothing. Remember we only have till MARCH 2nd to respond, that about 2 weeks only!

From the proposal: Therefore, the way I read it, IVA vehicles must meet the MOT requirements for a 1992 car. Not those used currently for new vehicles sold in volume, which are tested in a completely different manner to the basic MOT emissions check. This seems to give good info about that the MOT requires - www.gov.uk/government/uploads/system/uploads/attachment_data/file/676700/in-service-exhaust-emission-standards-for-road-vehicles-19th-edition.pdfMost cars with a cat and running even reasonably well will walk the test, the emissions the big companies have to achieve now are only a tiny fraction of what the MOT requires. Not the same thing. While I do think we should oppose the change, its unnecessary and has barely any benefit to the environment, we shouldn't think it means the end for modified cars. The change in effect mandates a cat and electronic engine management, which can be engineered for most engines. That document reads that the requirements for IVA would therefore be...

Where do you get 1992 from?
4.11 We are proposing that for kit cars, compliance with the MOT emissions standards current at the date of registration will be required, despite the use of an older engine. In other words the current relaxation for emissions according to the age of the engine will no longer apply.
"current at the date of registration" that means Euro 6!
