Car registered as in motor trade

I bought my bluebird in february and have been waiting for the new v5 since then due to the covid lockdown. Phoned dvla just now and they said that the car is showing as being in the motor trade and isn't on SORN. When I bought the car I understood it was a private sale and the guy was going to transfer ownership online. I've been trying to get to the bottom of this for months to no avail so ended up messaging the boy again today. He just told me that he bought it from a classic dealer which he left his details with to transfer v5 to him but then I bought it and he said he put the new keepers slip on the passenger seat which he couldn't have if he was waiting on the documents himself. Now I'm getting the old "you should have sorted it 6 months ago" and just pay for the new v5" all that wibblepoo. One thing for sure is that I WILL straighten him out he's curse word off the wrong person this time but my question is where do I stand legally with regards to a refund etc? Maybe similar has happened to someone else and can give me advice. So in a nutshell,

Said he transferred ownership online but car may not have even been in his name when he sold it to me.

Said the greenslip was in the car which is a load of wibblepoo.

Giving it the big ones now saying I should have sorted it months ago (couldn't contact dvla to enquire) and I should stop being a tight count and pay for the new v5

If he still had the V5C supplement that the dealer gave to him it'd be no different really - you could apply online and it'd pass over him as being a RK if the dealer didn't do their bit.


Is it worth the stress for £25 or whatever it is - that's the root question.

It's worth the time and effort putting this piece of curse word in his place aye. Lying to me call this time saying he put the greenslip in the car when he didn't even have a v5 there in his name? That sort of people (cowboys, dodgy traders and people that think they can just please themselves need to be shown the error of their ways and I take great pleasure in doing so!

Were you there in person when you bought the car? Should have been pretty easy to verify if he had the V5C logbook or the new keeper slip. If it was delivered to you, couldn't be something silly like the slip blew off the seat and is hidden in the car somewhere?

If the sellers story about the classic dealer not transferring it properly is true, and you can't find the green slip then you might be able to go to the dealer directly but that seems futile to me.

The seller might have been a trader but pretending to be doing a private sale? Not sure what benefit that would be to them, but difficult to prove I'd have thought

If there is no green slip with the car or documentation at all, then your best route is probably to apply for a new V5C and chalk it up to experience

Did you at least get a receipt proving you own the car before you go chasing up the previous owner or anything?

If I bought a car off a trader, and he gave me the green slip, I would have the green slip.

I could, therefore, pass it on to the next person, because it would allow them to tax the car and/or request another V5C if the original trader didn't change the ownership.


Having a V5C logbook in his name and having the current, valid, new keeper's supplement are mutually exclusive.

Don't have the new keepers slip he never gave me anything. Said he transferred ownership online and would put the new keepers slip in the car but he didn't do any of what he said he would

Also was a private sale and he never mentioned he was waiting on a new v5 himself just said he would put the slip in the car which wasn't there when the transporter dropped the car off, obviously because he had no v5 or new keepers slip himself

Little update,

I got the chassis number for the registration and have been told to check, problem is it has at least been painted over possibly removed. I'm not taking the paint off in case I get accused of destroying the number myself so the police are going to do it. My thinking now is that it has been reshelled at somepoint and rather than the buyer sorting it out they have just sold it on and stalled the paperwork for as long as possible to get them in the clear. Unfortunately for the previous owner the car has landed with me! If it has been reshelled then the black and white is he sold me a dodgy car that wasn't even his to sell. His name is matt, lives just outside Manchester and also owns a white r32gtr, white r35gtr and a grey mk2 golf with gold mesh wheels. STAY AWAY FROM HIM!!!. Don't know exact details yet but as it stands the police's fingers are all pointing at him and it's his head that's on the chopping block

Number is definitely not visable. Might be going down the wrong road but if someone found a red t72 hatchback, switched interior and put stickers on then pulled engine, ground number off and painted the whole engine bay before dropping the turbo engine in. Would explain why under the bonnet is mint and the rest of the car looks original

I'm not sure the background of how it got to this stage - If I bought a car in person and they said the v5 is in the car I'd go and get it out of the car and check the details before handing over any money.

As mentioned above if you bought it remotely and it got delivered then it's obviously a different ball game.

Good luck in sorting it - I guess you'll have to postpone the sale of it now too causing more headaches!?

I never bought the car in person. Had it transported up from beside manchester to North East scotland then the lockdown happened so couldn't do anything at all. Aye sale is postponed the car is going for a police inspection on the grounds it may be stolen so just need to wait now. Personally I don't think it's a clone but a reshell

The VOSA guys tend to know where any 'hidden' VIN/ID plates are. My mate had a Clio RSi converted from a BFG years ago and we had to trailer it them to ID it, and they were looking in pretty unusual places to ID it (tailgate shuts and all sorts)

Aye cjj the copper said there should be secret numbers somewhere. They said to check the chassis number but I said no in case I could be accused of destroying the number myself. Just some things not adding up and if my suspicions are correct the boy matt is in for a lot more  headache than I've had this week. Maybe he thought blocking my number would make this all go away LOL. All he did was stoke the fire! The police have his name, address phone number and bank details so he's going nowhere!!!

Take before and after pictures with something time and date stamped or get somebody to video you doing it so you can prove the before/after results, you'll wait forever for a police inspection.

I don't suppose that UV light or anything like that can be used to see any traces of the previous etching?  

I'm assuming Nissan aren't like Toyota and mark every panel with the VIN either?

They seem to be on it wu11lie already been in contact with my mate to see when they can view the car. I'm just leaving it to the police now cjj. I reckon the numbers on the glass and vin plate might match up to the reg but I don't think there's a number at all on the body. Everything's pointing towards a reshell

Either it’s just a straight forward log book not passed on
And you need to apply for it paying the £25
Or and this I’m hoping it ain’t
The car was ringed many years ago when it was probably a couple of years old
Either way I hope you get it sorted
