I think 40 bhp on that boat is not OTT, how long was it again?
My old black and white simms ran a 33hp Johnsons (older than yours) and was 14ft long. It was quick but perfectly stable.
What angle is the transom at in relation to the bottom of the boat. If the boat wants to nose up once on the plane, make the engine 'point down' by a few degrees. that will help to push the bow of the boat down and stop porpoising.
Have you got and far shots of the boat giving a sense of scale?
What is the transom made from? what thickness is the timber or ply?
Sorry for the questions, but it looks fine to me, but filling in some of these questions will give us a better idea of if there might be any potential issues.

Well I have just looked at the pics again, and it looks fine to me.
I would say you will get about 30 - 40 mph out of it flat out which is plenty fast enough.
Just make sure the transom and fixings are all in good condition etc. Take it out for a few low power runs to get used to it. You can't do more than 5 mph on the river anyway. Get down to a local watersports lake and go for a blast, but do a few short runs, then bring the boat back and check for any signs of deterioration of the transom.

Tbh, i think 40bhp is just right on that boat, so get it moving along nicely. We just sold a 15ft fletcher with a merc 90 2 stroke, that was a bit of a handful but the only reason it had suck a big engine was becasue we use towables too. As lewis said, that angle of the motor is important too

Also, you might see (and already done this) but the transom clamp will have some bolt holes in it (well it should).
Clamp the engine on vertically plump and on the centre line of the boat then drill and bolt the thing on with some bit bolts and nyloc nuts. That will make sure that if the clamps vibrate loose you don't lose the engine (which would be bad).
You might find that the boat torque rotates under full power. you can reduce this by setting the motor off centre by a few centimeters. Line it up central to start with, then go from there.
Waveman - I bet that fletcher was a handful. dread to think how fast that went flat out on calm water. Backflip tastic.

Waveman ?? I reckon that should actaully be my name :L Yep, accross rhoscoyln bay flat out, luckily it had power tilt/trim, but we still managed to break the seat on impact :L:L Not as bad as our old boat, it was a flat bottomed dory with a johnson 80, not great through the waves

Oh and also, you can put a padlock though the two screw motor clamps. If you look at them the have a hole in the end. Clamp the motor on, line them up and then put a padlock though them. Saves the engine being pinched, and should stop the clamps losening off.

Surely if it's too fast you just don't use full throttle?

Up in anglesey there were a load of motors stolen this year, we paddlocked ours so they took the bloody petrol tank Make sure those clamps are REALLY tight, my mate managed to drop our brand new 2.5hp merc off the dingy last year

Oh i will I'm gonna watch dog the bounty hunter quick then I'm off to fit the new impeller as it turned up yesterday.. , Turned out to be hard to find as its a slim model they only fitted between 73 and 76 on certain 35/40 hp engines... got it tho and its spot on original johnson...

Hmmmm, well the rear seat out of my dads bug fits it sortaItll need the base chopping slightly but thats not a problem as doing that will give me the original shape (up against edges) But be soft enough for it to pull out of the boat without dismantleing it. I'm going to make a support frame for it to hold it in one piece instead of two peices. Then a simple fitting at the front to allow it to be removed easily should the need arrise. And then its going to be recovered by a marine upholstery place my dad is friendly with ;D And some pics to give the boat a scale....
