Advice / opinion needed on new driver accident

Long story short

my son recently passed his test, earlier he was in an accident. He was going into a bend and a car came the other way and they hit. My son stopped at the point of impact the other car carried on and drove across his front, went past then stopped. 

No one was hurt. 

Slight Damage to the front drivers corner on his car, damage to the rear door and wheel arch on the other car. Both cars are driveable. 

There is a telemetric box in my sons car. 
No white lines on the road, area is very congested, lots of parked cars, residential area, other driver lives there.
he had P plates on his car
he has a witness, the other party was alone

now, as he has only passed his test a month ago will it be a "novice driver must be at fault" type of claim/blame or will the insurers take notice that if he passed his test recently then he won't have bad habits. 

Anyone been in this situation before, it's worrying the hell outta him. 

I've said to him it's insured, no one was hurt, can always be worse.

hard to say but maybe a 50/50 claim

Hi, insurance companies expect new drivers to have an accident in the first year. Doesn't mean they won't penalise him though, usually in the pocket.

Unless there's some evidence of who was at fault go for a 50\50 claim

When you say he has a witness, was it someone in his car or a bystander? If the witness was in his car they won't accept any testimony from them.

These days claims tend to always go 50/50 unless it's very black and white or a very expensive claim.

If possible try to sort out without going through the insurance best case will be 50/50 might seem mad but would probably be better to sort the other persons car out yourself if it won't cost to much saves all the insurance problems and will save your son being uninsurable had a mate with this problem a couple of years ago other party said the would take £500 quid and get there car patched up but my mates dad said no go through the insurance but after the accident was sorted out my mate couldn't get a quote on a 1.0 saxo for less than £4500 ended up buying a 125 scooter.

The worst bit of that is proving the car with damage to the front isn't at fault. That's usually where fault lies as it is assumed that one car drove into the other if the other party doesn't say otherwise.

Insurance companies never assume how an accident happened just because the damage is frontal but taking photos and getting witness details are very important.
