bought a car payd strong money for it,but its turned out to be a massive pill.broke all the buying rules,bought in dark etc.paid cash for it,if the sller either wont give me a lump of cash back or refund all my money and take his car back as it was clearly miss described how do i stand with ebay.would they take it further or what would be the course of action,any one had this problem and can anybody offer any advice.

You have a lot more rights if you bought from a trader.
If he was a private seller you don't get much in the way of rights it is basically buyer beware, about the only right you have is that it should be as described, though enforcing that might be hard work.

To be honest, I'd expect an N reg car to be rusty - I had to look over almost a dozen 1994/95 Fiestas to find a none rotter for my first car, and that was 5 years ago!
Unfortunately there is no real practical way to extract any recompense from the seller. While in the eyes of the law they have sold you a car that wasn't as described, it would not be worth your trouble persuing them as it would cost you more than just repairing the car.

i think you sumed it up yourself, you broke all the buying rules. I cant see you been able to get any money back what so ever, as u checked the car over and agreed to price it was sold as seen. Ebay wont care less about it.
i think most people have done it atleast once, its not nice but it happens alot.

did the guy have high feedback counts? is there alot of cars in it? has he got much for sale? if he values it all there are some ways of twisting arms, ie bidding on other bits ,take it to the trading standards ,taxman etc etc , if he is just a low use private guy you may be abit stuffed ! post his user id up on here ,if nothing else it will warn others off , good luck with this ebay is a fast becoming a bigger curse than ever!!

Yeah, 1995 cars do rot and I'd like to see the link too please. It's possible (but not definate) there is something you could nail him on but if he's a genuine private buyer you're just about knackered I'm afraid.

Buyer beware I recon. Ive bought loads of shitters in the past. I think you need to buy atleast one to learn the lesson properly.
Its worth asking for a partial refund, or even for him to buy the car back but if its a private buyer and they tell you to sod off I'm not sure if theres anything that can be done.
