Tis a strange one - I'd expect Diamond to pay out to the passenger's family and then recover off their insured. Bit unfair that the MIB - which we all subsidise by paying correct premiums - is paying out. This is the sort of thing that pushes insurance up. He did get in the car of his own free will though. I'm sure he had a good idea of how his mate drove. That was how I thought it worked too (though it is some years since I worked in that field). As I recall, it was almost impossible to get the MIB to pay for anything. Difficult to see why they went to the trouble and expense of getting the policy voided anyway; I might be wrong, but someone who spends his evenings in the passenger seat of his mate's chavved-up corsa probably isn't a big-earner. If he did have kids who were entitled to compensation it wouldn't be very much money. Perhaps the emphasis was on the 'modifications' to the car as they had tried and failed to prove the mother was 'fronting' the policy.

The main issue was that his mother did not turn up in court or have defence, if she had have it would have been a different matter, a quick plead of ignorance " i did not know it was modified i thought it was original and i know nothing about cars" Would have seen the insurance co. being made to prove otherwise (99.5% impossible) and they would have probably lost

It does highlight that something needs to be done about the way insurance risk is calculated.
I declare all mods like a good citizen, but was surprised to learn how Performance Direct calculate their policy. They valued my policy on the basis of the car I had taken the engine from, so a 2.8/2.9 sierra 4x4 that can do say 110/120mph set the rate for my 2.8 powered P100 which runs a diesel box and standard ratio axle - capable of about 85 on a private road officer!
Effectively they claim the donor vehicle is the bigger risk, hence the rate. Though as the engine was the most significant element to change (I only wanted to tow), there would be no additional charge for modified suspension/wheels etc.....
I just wonder if anything modified should have an inspection? Therefore making modified insurance easier/fair/safer and people less likely not to declare.
I also wonder how the poor passenger got thrown from the car whilst wearing his seatbelt?

ive always told them of everything, supplied pictures if it agreed value. The insurance on my first mini with window tints and 6x10 alloys was so expensive it worked out at 4 times the value of the car, but back then clubman estates wernt worth a bean.

Not reading through all the replies on here but just the story itself two things strike me. 1) She was insuring the car under her name but the son was doing most of the driving. Fronting and it's illegal.
2) the modifications were not declared. Therefore invalidating the policy. When the car was purchased for £770 it is almost certainly likely it was advertised as having lowered suspension and a bodykit as these would be selling points. Therefore to plead ignorence is a bit weak imo.
The cost of insurance is very high and if the car is modified even more so, but rules are rules, i paid £1400 for a 1.1 Fiesta that was modified in my first year of driving, and was made to get my own policy within a few months of passing as i was driving the car more than my mum.

Fronting and it's illegal. . Not only that, but arnt Diamond a company that specializes in insurance for women? Doesnt make it any more legal/illegal, but it does take the pee just a little bit more.
