Moving a car with an expired mot....

Situation is, I need to move a car but the mot/tax has expired and i need to get it to mine to do a few bits, cv boot, change the windscreen etc so nothing major. But i can't do the work where its currently stored....

I'm quite happy to get day insurance but do i need to have it pre-booked in for an mot to be safe driving it?

Its a distance of about 12 miles.....

My current plan was to book it in for an mot at the garage up the road and then cancel the mot once i have got to my place (would then book it in the following week), so that if i'm stopped by the police I can demonstrate i was heading to the mot station...etc...

Thoughts?

you are legally allowed to drive a car with no mot to the NEAREST mot station, so if you got pulled i think you may be screwed if you have driven past alode of garages on your way and as said, your car crushed.

you would need to get the garage's agreement, as they wont be happy to be used, and if you get reported, then you will have to prove you were legal, which you could only do with the garage's help.

if your car fails, then it's proof, if the garage cancels it's also proof, if you cancel, then you could be fighting something more serious than no tax or MOT.

incorrect, there is no requirment in law to take it to the nearest MOT station, only that it must be booked into a MOT station

so as has been said trailor it, or fix it where it stands and MOT it, no matter whether it's booked in for a MOT or not, If it's unroadworthy, then you risk a fine at least!

Why one earth would anyones car get crushed? That's not currently the punishment for any offence I'm aware of, let alone driving with no MOT. They can impound the car, then if you don't bother reclaiming it, or state that you don't want to, they will dispose of it, be that sell it or crush it.

It doesn't have to be the nearest MOT station, it just has to be a pre-booked test. You are also allowed to drive the car to a place at which work required for the MOT test is to be performed. I can't confirm the exact wording of that last bit off the top of my head, so don't know if what you propose would be covered by it, but as long as it's not dangerous to drive in it's current condition (which has nothing to do with MOTs) then you should be covered if you booked it for an MOT, took it to it, let it fail, drove it home, fixed it, drove it back to the test station for a nice fresh ticket, which as long as you can do the repairs within 10 days/2 weeks, shouldn't cost you anymore anyway.

You'd also obviously have to check with your insurer that they're ok with it.

I'd get a quote from a local transporter. You might find they want less than a days insurance will cost.
Otherwise do you have a mate with a Transit van, Land Rover etc that has a towbar ? If so might they tow a hired trailer ?

You will be on shakey ground BUT I would keep your home number as the pre booked place of work and get your dad or somone to sit near the phone and play the mechanic waiting for the car to arrive till you get there.
Print this out and carry it with you, I do when moving un MOT'd or taxed cars to my yard, it is for no tax but is the same for an un MOTd car just remember any seriouse defects will incure the same penalty as an MOT'd car so no bald tyres ect
this was on the gov site before they redid it, I cant fing this exact same quoye anymore but it works, been pulled a few times and I wip this out along with my trade insurance and get sent on my way

"You do not need an excise licence (tax disc) when taking an unlicensed vehicle to a pre-booked test, when driving it away from such a test, delivering it by prior arrangement to a place where work is to be done if it has failed or bringing it away from that place In such circumstances it is an exempt vehicle as defined in Section 5 and Schedule 2 of the Vehicle Excise and Registration Act 1994:

"22 (1) A vehicle is an exempt vehicle when it is being used solely for the purpose of—
(A) submitting it (by previous arrangement for a specified time on a specified date) for a compulsory test, or
(B) bringing it away from a compulsory test.

curse word that , too risky , for about 60-70 quid you can get a dude in a truck to collect it and drop it to your door , much safer and the car don't need to touch the road so no fines etc,.

as long as the car has insurance and is booked into a mot station for an mot you can drive it from a (home) to point b (mot station) and pass or fail drive back to point a (home) but it has to be booked in ie your name the full reg and make of vehicle

So a vehicle doesnt have to be taxed to get to and from an mot by driving? I always thought that was a bit of a grey area

No as long as the vehicle has insurance and the driver has a licence you can take it for mot but as some one has said ( if the police stop you and find defects they can fine you ) but they can not inpound the car

To and from the MOT is probably the only non grey area for driving with no tax, it's allways been that clear cut

Wrong, there is case law that stopping at a shop on your way to an MOT is covered by the exemption.

Secretary of State for Transport V. Richards ( 1998 ) JP 682

The defendant stopped for petrol and then stopped for fags on his way to a test, he was convicted by magistrates, appealed at CROWN court and the judgment was overturned. The prosecution appealed this judgement but it was upheld.

"it is only if this court is satisfied that no court could reasonably have come to the conclusion that it did that it can interfere. On the facts of this case, it is ridiculous if a driver could not stop to obtain petrol on the way. it would fly in the face of common sense if some short stop cannot be made by the driver, for whatever purpose, providing he is on his way to the test station."

TBH i think that it's quite bleeding obv you'd get dome for shopping on the way to the MOT cos to my mind to and from the MOT means straight to and from
TBH i would disagree with the court case as well, petrol yes, essential for the MOT but fags ? to my mind that's not really in the spirit of "to and from", hang on why am i arguing with a court case that makes me right

A few years ago i took a none taxed car to be mot'd first thing one morning, all booked in and above board and it passed. Upon leaving the garage i popped into the post office round the corner with all my doc's to re-tax it. Low and behold when i came out of the post office, dibble is looking over the car!. As i approached them i couldn't help laughing (what a coincidence to have that happen literaly within minutes of parking up!). That caused the police officer to go off on one and how serious an offence it was to drive a none taxed car on the road blah blah blah. Obviously i had the new tax in my hand, insurance certificate plus the dated new mot of that morning from literally 500 yards away!. He was chomping at the bit to go for a prosecution, to which i said if you really think it'll stick in a magistrates court then go for it, but i'd like to think that some people have some common sense!. He left in a huff.

Police and common sense aren't words i use in the same sentence any more....
