So, I've been caught speeding and just read through my form (82 in 70 mph limit) but I had good reason for doing so Me, my gf and her brother (who is mentally ill) were going out for the day to Woburn Zoo, to show her brother the animals. On the way we realised that we didn't have his mediacation that stops him from having fits, and he was starting to show signs of them coming on. So I drove a little fast to try and get home quickly before anything bad happens, as if he has a fit without the mediaction he could die. Going too fast, I passed a police van on the side of the duel carrageway so thats where I got zapped. This is my first involvement in this sort of thing, so I'm not really sure what to do, do I just send in an explanation on a separate piece of paper? Is it worth bothering or will they actually read it? oh and a pic of the car to keep it interesting, I was surperised it did 82 mph! thanks for reading, and thanks in advance for any help

I've been told (By quite a senior police officer) that now is the best time ever to send a letter in and try and contest this sort of thing - The police have spent hundreds of thousands of pounds on public image gurus, and they now need to be seen as "serving the community" rather than the ever increasing image of them just meeting targets however is easiest.

CONTEST IT!
I dunno if it still works but I got nailed for speeding in England once with one of those mobile cameras. My lawyer came up with this 'loophole'. He insisted as I was scottish and lived in Scotland the case should be conducted by scottish law. Slightly mistified the Judge agreed. At the hearing my lawyer told me what was going on and what to say. The Judge asked 'are you the owner of the Red BMW 323 UMS***X?' I replied 'Yes' He asked 'were you at (wherever it was) on the A6 on (whatever date it was)?' I replied 'Yes' again! 'Where you driving your car at this time on this date in that location?' he asked, 'I cannot answer that question on the grounds it will incriminate me.'
Verdict = Not proven!
Dunno if it still works as it was a few years ago.
Anyway, Octagonal, I'd contest it. Regardless of her bruv!

The forum to ask this sort of thing on is pepipoo.com really. tell essex police that. any event on in southend and the a127 is full of scamera vans counted 5 mobile units on my way back from the workshop the other week on the day of the southend airshow and that's not counting the 3 static and 5 miles of average cameras on the same road

Its worth sending a letter off with the form stating you were the driver, They can only say no. Its known as a letter of mitigation. Failing that you could just ignore the request to cough up and wait for the court summons (often, this never arrives) and talk to the magsitrate about it. Local magistrates arnt scary places. Not exactly fun but nothing to be worried about. They could whack you with more points and a bigger fine though. www.pepipoo.com has a great forum for stuff like this. Sign up and chat to the members. You have 28 days to respond to the NIP so don't feel rushed, and don't lose sleep over it. curse word happens.

ive just had a nip for 38 in a 30 at 2 am on a sunday night I'm tempted to go to court and ask for the photo,s which will show no other vehicles to be seen and the road which is the a34 between stoke and newcastle which is a dual carriageway

I know of a way to easily get you off but it would mean scrapping the car (at least on paper) only really useful if it was a car you were planning on doing that anyway in the near future.

While I do of course agree with everybody else that you should contest it because there's nothing to lose and it is quite clearly a valid reason for what you were doing... It is of course, technically speaking, a strict liability offence and so the reason for the speeding should be entirely irrelevant. In reality though, mitigating factors seem to play a huge part so I wish you good luck

I assume by scrapping it and saying it wasnt you driving because you scrapped it ages ago. Worth writing in a letter explaining the situation tho pal. might be one of those 'let you off situations' like getting a police escort to the hospital or summit. Good luck I do however think its karma for not cutting your springs ;D

Even if the pic shows there was nobody else about you will still get the points. If you were speeding its a closed case- unless you have a damn good excuse. don't go to court unless you have a good chance of getting off, otherwise youll probably get a £120 fine instead of a £60 one. However if everyone excercised their right to be heard in court over speeding cases then the court system would soon collapse and everyone would get off scott free The system relies on people just paying up as soon as they get the NIP through the post. local mags courts are already swamped with traffic cases, I think its 75% of the work they do .
