to add to some of the comments made in this thread, a few facts about how the backwards laws in this country work- having your name on the v5c for a vehicle means exactly jack sh1t. it is no proof whatsoever you own or even have an interest in said vehicle. any person can apply for any v5 for any vehicle at any time, and its down to the current person on the v5 to contest that application within a given time(you are informed by mail to ask if you still own said vehicle or not) or a new v5 in the new applicants name is automatically issued- remember that if you have a prospective buyer looking over a car and wanting to write down the chassis no, engine no and number plate to 'check the cars details'............. also, if you form a contract with someone by agreeing to sell them an item, or buy something from them, be it vebally or in writing, the item istantly becomes the property of the buyer, even if they have not paid a penny for it. that contract can be upheld in a court of law, even if a deposit hasnt been paid. in practice, this is pretty much impossible to prove with verbal contracts unless you record the conversation. remember it if your buying and selling online and corresponding by email though..... for example, if someone agrees to buy a car from you, and pays a deposit, then doesn't come up with the rest of the cash in the agreed time period, you're legally entitled to keep the deposit, or a reasonable proportion of it, to cover your expenses- storage, advertising costs, correspondence, making a loss on the agreed price when selling the car again, solicitors fees, etc. conversely, if you agree to buy a car from someone then they then sell it to someone else without giving you reasonable opportunity to pay for and collect it, they can be prosecuted for theft and/or obtaining money by deception. can i ask if you have 1st hand experience of the laws you mention, as i havent heard of some the above laws ( as a layman)

OK, can I ask a question without a hint of criticism here?
What would have happened if when you had the car you had applied for the V5C? Cos then the person (using the term loosely here!) would have had the letter telling him he has ten days to reply. Presumeably then he'd have written off to DVLA saying, hey that's my car... what happens next? Same thing with the police or what? Anyone got any ideas?

I would have applied for the V5C if I knew the registration mark..... (see earlier) I did enqire with DVLA and the police when I first got the car, DVLA had "no record" and the police said it was not reported stolen, which it wasn't at the time I enquired. The length of time I had the car, and my (provable) efforts in tracking down its identity are the main reasons I'm sore that they just gave it to the man with a logbook.
Oh yeah, and the question? if the previous keeper contests a v5c application with DVLA, but he doesn't have the car in his posession, swansea issue the v5c to the new keeper and advise the old keeper to sue.

EXACTLY my point- how easy would it be to-reapply for a v5 for a car youve just sold, and have a spare set of keys and the new keepers home adress (seeing as the v5 is now sent off by the seller) to go thief it back.......? hell, you wouldnt even need to do that, as the buyer will have given you the existing v5, and their adress!! the whole v5 system is wide open to abuse/fraud by both buyers AND sellers, so you have to be very careful about who you do and don't let view a car, let alone buy one from you, as well as who you buy from!!

Or would it just make me look like a bigot? ;D maybe if you'd been messed about one way or another constantly by say a dozen seperate people from stoke then i daresay you'd be entitled to say 'i'm starting to think all the men in stoke-on-trent are nobbers'. i'd consider it reasonable, and i'm a beacon of reasonableness to all around me

Surprisingskoda is right. I really don't want to think all OB are jumped up power freaks but in all honesty I can't help but think much different some days. I respect anyone who respects me and I don't go giving the OB any hassle either, but (aside from a couple of cracking traffic cops about 4 months ago who puled me over) they sure as hell like giving me sh1t for no reason. You don't need to be one of those Jeremy Vile/spotty herbert types either (who give police lip and then moan if they get it back) to cop unneccessary flack from our uniformed friends nowadays I'm afraid. The difference is realising that not all police are bad, even when you've had bad experiences with them recently as they certainly not all bad.

I agree totally, when I ditched my Corsa the two Avon and Somerset traffic boys helped me no end, the other A & S traffic that pulled me on the M5 later the same evening to tell me my light was out even apologised to me for stopping me! Then 5mins after crossing the border I was pulled by the Devon & Cornwall boys and they had the on right from the word go and gave me my second producer of the the day despite having seen the first one! Seam welded front end saves the day!

What a b1tch of a situation, missed this thread first time 'round. Trust no-one! Incidentally whenever dealing with Police (fourteen times in the past year or so! ), I squeeze the fact that I'm a qualified accountant into the "conversation" ASAP. Surprising how their attitude changes. Without fail. All of a sudden I'm not just some Sierra owner in a hoodie with grubby nails, living on a council estate, I'm "Sir". Moral: Pretend to be an accountant.
